The reform process, that led to the definitive overcoming of the Hospitals for the Criminally Insane and the foundation of REMS (literally "residences for the execution of security measures"), has been long and complex. The legislator, acting in the name of the legal pro-tection of health and dignity of mentally ill offenders, sanctioned the demise of those structures that with many difficulties took care of the detained, revealing themselves as real places of custody and segregation, where people were deprived of the most basic person's rights. Moving from legal and psychiatric debates that started during the 19th century, which produced the establishment of criminal asylums, this article describes the transformation process of these institutions, in the period between 1904 and 2014, then focus on REMS analysis, looking at its potentiality and criticality.
