Renato Treves : una sociologia del sapere giuridico
81-114 p.
The text examines different cultures that influenced Renato Treves's education. Through his various experiences as a refugee, Treves discovered new approaches to legal knowledge. From Karl Mannheim, Treves drew the idea of a sociology of culture, conceived as a tool for the knowledge of law, of interpretation, of social expectations, and of conflicts that may arise from law enforcement. The sociology of legal knowledge finds an important application in Treves's work Giustizia e giudici nella società italiana, in which the ideology emerges that managing classes, legislators and judges use to legitimize their work, as well as the social conflicts that give rise to new hypotheses of legislative reforms in the post-modern era. As Vincenzo Ferrari reminds us, Treves highlights the impact that the crises of the Welfare State had on legal knowledge and on the concept of law as a tool for the distribution of resources.
