Ethics, law and the global political theory : a critique of habermasian cosmopolitan perspective

2015 - Editoriale Scientifica

269-292 p.

This paper focuses on Jürgen Habermas's cosmopolitan perspective. In doing so, the research question is the following: since there is no strong civic solidarity, because it is threatened by different levels of conflicts which do not allow the establishment of an ethical community, how is it then possible to conceive of a cosmopolitan solidarity and the global political theory? To examine this question, this paper is divided in five sections. The first section has the aim to explore the notion of civic and cosmopolitan solidarity. The second section stresses the importance of the relationship between Habermas and Kant. The third section analyses the new international order in the light of the Kantian vision. The fourth section concludes with the project of Hans Kelsen to present a cosmopolitan alternative. [Publisher's text].
